(ASCEND) 31200 instead of 33600 with 5.0Ap38 ?

[Max 4000 with k56flex, FR, ISDN and modem users]

I have two problems with 5.0Ap38

Modem users connect with 31200 instead of 33600 

and after installing 5.0Ap38 modem users get kicked out off the max after
about 3 minutes. Therefore I put back 5.0Ap16 (which worked) but they still
get kicked out. And the problem remains with 5.0Ap36. Any ideas ?
