Unless it's under a GNU license? Not necessarily. What RMS is playing a semantics game. The term "Open Source" is a non-specific term, describing software for which you can obtain the source code. That software may be GPL-licensed, in which case you can modify it, use it in your own code, etc., as long as you stick to the terms of the original GPL license.
