You are correct. OpenZFS is open source among ports. ZFS is not.

It may be just a matter of semantics. When Oracle acquired Sun, it locked
down Solaris and everything that belongs to it, including ZFS. OpenZFS was
developed as part of OpenSolaris which is now discontinued.

What I should have said is Solaris ZFS is no longer open source which is
irrelevant in this case so I stand corrected.
